These "General Terms and Conditions of Sale" apply to legal transactions concerning the products marketed to its customers by www.sauce-piquante.fr within its virtual store at the address www.sauce-piquante.fr.

Definitions:

The words or expressions below shall, within the scope of these terms, have the following meaning:

• Online store: refers to the website www.sauce-piquante.fr on which products are presented and sold to customers.
  
  
• Order: refers to the sales contract concluded between www.sauce-piquante.fr and the customer of the online store www.sauce-piquante.fr.
  
  
• Products: refers to all goods offered for sale by www.sauce-piquante.fr in its online store.
  
  
• Transaction: refers to all operations, secure processing, authorizations and agreements inherent to the payment of the price of products ordered by credit card.
  
  

Article 1 - Subject:

These general terms and conditions of sale are intended to define the terms and conditions under which SAUCE PIQUANTE SAS offers and sells its products to individual customers (excluding professional customers).

Article 2 - Acceptance of terms:

The customer acknowledges having read these general terms and conditions of sale when placing their order. By validating their order (selecting payment on the page www.sauce-piquante.fr/commande.php), the customer accepts these terms and conditions of sale.

Article 3 - Order:

Automatic recording systems are considered as proof of the nature, content and date of the order.

SAUCE PIQUANTE SAS will confirm the acceptance of the customer's order by sending a confirmation message to the email address provided by the customer. The sale will only be concluded upon sending of said order confirmation.
www.sauce-piquante.fr reserves the right to refuse or cancel any customer order, particularly in the event of the customer's insolvency, or in the event of non-payment of the relevant order or a previous delivery, or a dispute relating to the payment of a previous order.

The information provided by the customer when entering details relating to their order is binding upon them. www.sauce-piquante.fr cannot be held responsible for errors made by the customer in specifying the recipient's contact details (delivery address, billing address in particular) and any delivery delays or inability to deliver the ordered products that such errors may cause.

Article 4 - Delivery

After confirmation of the order by www.sauce-piquante.fr and payment of the order by the customer, www.sauce-piquante.fr undertakes to ship the ordered products to its customer, under its responsibility, to the delivery address within 2 to 5 days (excluding public holidays).

All products specified in orders placed at www.sauce-piquante.fr are intended for the personal use of customers or recipients whose name is mentioned at the delivery address.

Customers or recipients of products are prohibited from reselling the products, whether partially or in full.

Delivery will be carried out by a transport provider or exceptionally directly at www.sauce-piquante.fr at 3 A rue du Sommerberg, 67750 SCHERWILLER.

Any delivery delays attributable to the carrier or to www.sauce-piquante.fr do not entitle the customer to claim damages.

Ordered products are transported at the risk of the recipient. Upon receipt of the ordered products, the customer or recipient must verify that the delivered goods are in proper working order.

In the event that one or more of the ordered products are damaged (something we do our utmost to avoid), the customer or recipient must file a complaint with La Poste at the time of delivery, provide us with a photo of the damaged products, and the products from the order will be reshipped subject to available stock.

In the event that the package shows signs of having been opened upon receipt at a collection point, or if the package appears to be much lighter than what the customer ordered, the customer must absolutely refuse the package.

The following are considered force majeure events releasing www.sauce-piquante.fr from its delivery obligation: war, riot, fire, strikes, accidents, and the impossibility of being supplied.

Article 5 - Withdrawal

The customer of www.sauce-piquante.fr has a withdrawal period of 14 days from the date of receipt of the products shipped by www.sauce-piquante.fr. During this period, the customer may return their order for an exchange or refund. In the event of a return, the customer must return the entire order in good condition without having used the products, even partially. The order must be returned at the customer's expense to 3A rue du Sommerberg, 67750 Scherwiller. Please make sure to protect the bottle being returned so that it arrives intact in order to process the refund; if it is damaged or opened, the product will not be refunded.

Article 6 - Prices

The prices displayed for each product are in Euros including all taxes, excluding shipping costs. Shipping costs are calculated on the total amount of the order.

Article 7 - Payment

The price of the order is the one displayed in the order confirmation email. The customer has 2 payment methods available. Payment by credit card on the bank's secure website, and payment via PayPal. The order will only be dispatched upon receipt of payment and its validation by the bank. www.sauce-piquante.fr never asks its customers to provide their banking information by phone, fax or email; www.sauce-piquante.fr never comes into possession of your banking information — the bank only transmits the result to us (payment validation or not).

Article 8 - Applicable law

These general terms and conditions of sale are subject to French law.

Article 9 - Product information

Our product offers are valid as long as they are visible on the site, subject to available stock.

In the event of a product being unavailable after your order has been placed (stock error, damaged product), you will be notified by email or phone. We will offer you:

either a refund for the missing product(s) by credit card, check or PayPal,
either a refund as a store credit voucher,
either a replacement with products of your choice of equivalent value to the missing products,
or outright cancellation of your order.

Validation will be suspended until your response (within 3 working days), in which case we will refund the missing item.

The photographs illustrating the products offered on the site are provided for informational purposes only. There may be some variations. The mention "non-contractual photo" informs you that the products may differ from the photo and that only the description of the gift set will be taken into account.

Information on the strength of sauces. The strength of the sauces is expressed in Scoville units on the www.sauce-piquante.fr website. In order to rank the sauces, we use data provided by the brands and our own tastings. The values are purely indicative and cannot under any circumstances give rise to a request for a refund or exchange in the event of disagreement.

Article 10 - Liability

Sauce Piquante France under www.sauce-piquante.fr cannot be held responsible for damage of any nature, whether material, immaterial or bodily, that may result from malfunction or misuse of the marketed products. The same applies to any modifications to products made by manufacturers.

The liability of www.sauce-piquante.fr shall, in any event, be limited to the amount of the order and may not be invoked for simple errors or omissions that may have remained despite all precautions taken in the presentation of products. In the event of difficulties in the application of this contract, the customer and www.sauce-piquante.fr reserve the option, before any legal action, of seeking an amicable solution.

Failing that, for customers, the Commercial Court of Colmar has sole jurisdiction, regardless of the place of delivery and the accepted method of payment.

Article 11 - Warranties

In all cases, www.sauce-piquante.fr cannot be held responsible for non-compliance with the regulatory and legislative provisions in force in the country of receipt. The liability of www.sauce-piquante.fr is systematically limited to the value of the product in question as determined at the date of its sale, with no possibility of recourse against the brand or the company producing the product. In any event, the customer benefits from the legal warranty against eviction and hidden defects provided for in articles 1625 et seq. of the Civil Code. Article 12 - Legal information

The provision of personal information collected for the purposes of distance selling is mandatory, as this information is essential for the processing and dispatch of orders, the preparation of invoices and warranty contracts. Failure to provide this information will result in the order not being validated. In accordance with the "Data Protection and Civil Liberties" law, the processing of personal information relating to customers has been declared to the Commission Nationale de l'Informatique et des Libertés (CNIL). The customer has the right (article 34 of the law of January 6, 1978) to access, modify, rectify and delete their data, which they may exercise by contacting www.sauce-piquante.fr. Furthermore, www.sauce-piquante.fr undertakes not to share, free of charge or in exchange for payment, its customers' contact details with any third party.

Article 13 - Use of products

Sauce Piquante SAS cannot be held responsible for misuse of the products. Each customer undertakes not to use the sauces with children under 18 years of age and to store the sauces out of reach of such children so that they cannot access them. Extreme sauces should also be consumed in moderation. In all cases, Sauce Piquante France cannot be held liable.

Article 14 - Personal data

Sauce Piquante SAS does not resell or exchange any personal data. The information collected is used exclusively internally to improve the quality approach with its customers. Only the email provided at account creation and the purchase order are transmitted to AVIS VERIFIES in compliance with French legislation.

Article 15 - Mediation

In accordance with the provisions of the Consumer Code concerning "the consumer dispute mediation process", after having contacted us and in the absence of a satisfactory response, you have the option of using a consumer mediation procedure free of charge with:
