These "General Terms and Conditions of Sale" apply to legal transactions concerning products marketed to its customers by www.sauce-piquante.fr within its virtual shop at the address www.sauce-piquante.fr.
Definitions:
The words or expressions below will have the following meaning within the framework of these terms:
- Internet Shop: refers to the website www.sauce-piquante.fr on which products are presented and sold to customers.

Article 1 - Purpose:
These general terms and conditions of sale aim to define the terms and conditions under which SAUCE PIQUANTE SAS offers and sells its products to its individual customers (excluding professional customers).
Article 2 - Acceptance of Conditions:
The customer acknowledges having read these general terms and conditions of sale when placing their order. When validating their order (choice of payment on the page www.sauce-piquante.fr/commande.php), the customer accepts these terms of sale.
Article 3 - Order:
Automatic registration systems are considered as proof of the nature, content, and date of the order.
SAUCE PIQUANTE SAS will confirm to the customer the acceptance of their order by sending a confirmation message to the email address that the latter has provided. The sale will only be concluded upon sending of said order confirmation.
www.sauce-piquante.fr reserves the right to refuse or cancel any order from a customer, particularly in case of insolvency of said customer or in the event of a payment default for the order concerned or a previous delivery or a dispute relating to the payment of a previous order.
The information provided by the customer when entering details for their order is binding. www.sauce-piquante.fr cannot be held responsible for errors made by the customer in the recipient's contact details (delivery address, billing address in particular) and for any resulting delivery delays or inability to deliver the ordered products.
Article 4 - Delivery
After confirmation of the order by www.sauce-piquante.fr and payment of the order by the customer,
www.sauce-piquante.fr commits to ship to its customer, under its responsibility, the ordered products to the delivery address within 2 to 5 days (excluding holidays).
All products specified in orders placed on www.sauce-piquante.fr are intended for personal use by customers or recipients whose names are mentioned at the delivery address.
Customers or recipients of products are prohibited from reselling the products in part or in whole.
Delivery will be made by a transport provider or exceptionally directly at www.sauce-piquante.fr at 3 A rue du Sommerberg 67750 SCHERWILLER.
Any delivery delays attributable to the carrier or www.sauce-piquante.fr do not give the customer the right to claim damages.
The ordered products are transported at the risk of the recipient. Upon receipt of the ordered products, the customer or recipient must verify the proper functioning of the delivered item.
In the event that one or more of the ordered products would be damaged (which we avoid as much as possible), the customer or recipient must issue a reservation with La Poste at the time of delivery of the order, provide us with a photo of the broken products, and the products of the order will be reshipped within the limits of available stock.
In case the package shows signs of opening upon receipt at the pickup point, if the package is much lighter than what the customer ordered, the customer must absolutely refuse the package.
War, riot, fire, strikes, accidents, and the inability to be supplied are considered cases of force majeure releasing www.sauce-piquante.fr from its obligation to deliver.
Article 5 - Withdrawal
The customer of www.sauce-piquante.fr has a withdrawal period of 14 days from the date of receipt of products shipped by www.sauce-piquante.fr. During this period, the customer can return their order for exchange or refund. In case of return, the customer must return the entire order in good condition without having used the products, even partially. The order must be returned at the customer's expense to 3A rue du Sommerberg 67750 Scherwiller. Please ensure to protect the returned bottle so that it arrives intact for the refund process; if it is damaged or opened, the product will not be refunded.
Article 6 - Price
The prices displayed for each product are in Euro including all taxes, shipping costs not included. Shipping costs are calculated on the total order.
Article 7 - Payment
The price of the order is the one displayed on the order confirmation email. The customer has 2 payment methods available. Payment by credit card on the bank's secure site, and payment via PayPal. The order will only be shipped after receipt of payment and its validation by the bank.
www.sauce-piquante.fr never asks its customers to provide their banking information by phone, fax, or email, www.sauce-piquante.fr never comes into possession of your banking information, the bank only transmits the result to us (payment validation or not).
Article 8 - Applicable Law
These general terms and conditions of sale are subject to French law.
Article 9 - Product Information
Our product offers are valid as long as they are visible on the site, subject to stock availability.
In the event of product unavailability after placing your order (stock error, product breakage), you will be informed by email or phone. We will offer you:
either refund of the missing product(s) by credit card, check, or PayPal,
or refund in store credit,
or replacement with products of your choice equivalent in value to the missing products,
or pure and simple cancellation of your order.
Validation will be suspended until your response (within a limit of 3 working days), in which case we will refund the missing item.
The photographs illustrating the products offered on the site are provided for indicative purposes. There may be some variations. The mention 'photo not contractual' informs you that the products will be different from the photo and that only the description of the set will be taken into account.
Indication on the strength of sauces. The strength of sauces is expressed in Scoville units on the www.sauce-piquante.fr website. In order to obtain a ranking of sauces, we use data provided by brands and our own tastings. The values are purely indicative, they cannot in any case lead to a request for refund or exchange in case of disagreement.
Article 10 - Responsibilities
Sauce Piquante France under www.sauce-piquante.fr cannot be held responsible for damages of any nature, whether material, immaterial, or bodily, that could result from malfunction or misuse of the products sold. The same applies to any potential modifications of products made by manufacturers.
The liability of www.sauce-piquante.fr will, in any case, be limited to the amount of the order and cannot be held responsible for simple errors or omissions that may have persisted despite all precautions taken in the presentation of products. In case of difficulties in the application of this contract, the customer and www.sauce-piquante.fr reserve the possibility, before any legal action, to seek an amicable solution.
Otherwise, for customers, the Commercial Court of Colmar has sole jurisdiction, regardless of the place of delivery and the accepted method of payment.
Article 11 - Warranties
In any case, www.sauce-piquante.fr cannot be held responsible for non-compliance with regulatory and legislative provisions in force in the country of receipt. The liability of www.sauce-piquante.fr is systematically limited to the value of the product in question determined at the date of its sale and this without the possibility of recourse against the brand or the company producing the product. In any case, the customer benefits from the legal guarantee against hidden defects provided for in articles 1625 and following of the Civil Code. Article 12 - Legal Information
The provision of personal information collected for the purpose of distance selling is mandatory, as this information is essential for processing and shipping orders, issuing invoices, and warranty contracts. In accordance with the "Data Protection Act", the processing of customers' personal information has been declared to the National Commission for Data Protection and Liberties (CNIL). The customer has the right (Article 34 of the law of January 6, 1978) to access, modify, rectify, and delete data concerning them, which they can exercise by contacting www.sauce-piquante.fr. Article 13 - Use of Products
Sauce Piquante SAS cannot be held responsible for misuse of products. Each customer agrees not to use the sauces with children under 18 years of age and to store the sauces out of reach of these children so they cannot access them. It is also advisable to consume extreme sauces in moderation. In any case, Sauce Piquante France cannot be held responsible.
Article 14 - Personal Data
Sauce Piquante SAS does not resell or exchange any personal data. The collected information is used only internally to improve quality processes for its customers. Only the email provided during account creation and the order form are transmitted to AVIS VERIFIES in compliance with French legislation.
